REFERRAL INCENTIVE
Offer is available for redemption between 1-31 October 2024. Refer a friend and if that friend joins an Unlimited or 3 Class membership, the referrer and referee will each receive 10% off their weekly rate. 10% discount will be valid for the lifetime of the referral. Referral initiative is valid for one person only + cannot be stacked. Cannot be used in conjunction with any other offer.

DECEMBER FREE
Offer is available for redemption between 3-31 October 2024 and applies to an Unlimited or 3 Class membership signup. Use code DECFREE at the checkout of the Athletic Revolution App to pay nothing ($0) in December. If you sign up a friend in October, in accordance with these terms, you'll pay nothing ($0) in January. Membership is non-refundable and non-transferable. Should you wish to cancel at any time, you may do so by completing a Cancellation request via our website. Cannot be used in conjunction with any other offer.

GENERAL
Camant Enterprises Pty Ltd T/A Athletic Revolution (‘GYM’) uses all reasonable measures to comply with the ‘WA Fitness Industry Code of Practice’ (‘the Code’) and this membership is offered in accordance with the Code.

These Terms & Conditions are subject to change at the discretion of GYM management. Please be sure to read this document thoroughly and be sure to ask any questions prior to signing your Membership agreement or making a purchase.

GYM reserves the right to change conditions of Membership, hours of operation, services offered and all fees and charges, at any time, at its sole discretion. Any such changes will be communicated in writing to you via GYM email/website.


MEMBERSHIP
You agree to pay GYM the membership fee specified via the Athletic Revolution website, in advance on a 14 day autopay schedule, by credit card or bank account transaction. You acknowledge that your Membership will continue on an autopay schedule unless GYM is notified of a cancellation request in writing (see Cancellation Policy).

Additionally, you agree to pay the Mindbody processing fees that apply to you each fortnight by Credit Card or BECS Direct Debit:
- Credit Card: VISA/Mastercard/AMEX 1.89% + $0.50
- BECS Direct Debit: $0.80

You acknowledge that Mindbody Payment processing may take 1-2 business days (Credit Card) and 1-3 business days (BECS Direct Debit) after your scheduled GYM Membership date.

You must inform GYM of any changes to your payment details at least 72 hours before the next payment day. If your Membership is paid by Credit Card, you may update your payment details online.

Payment via BECS Direct Debit can be applied to your Membership when GYM is notified of your request in person or by completing a BECS Direct Debit form.

You acknowledge that should you not be able to attend class, your responsibility to pay the GYM Membership fees as set out in your agreement remains.


COOLING OFF PERIOD
Where you have entered into a Membership agreement with GYM, there is a seven (7) day cooling-off period that begins on the date your Membership agreement is signed. You may terminate your Membership during the cooling-off period by completing the online cancellation form or by delivering written notice via email (contact@athleticrev.com.au) to GYM. In which case, you will be refunded one weeks’ Membership fee and your cancellation will take effect immediately.


FAILED PAYMENTS
It is your responsibility to ensure there are sufficient funds in your account on your scheduled debit day.

If your scheduled fortnightly payment declines for any reason, Mindbody will reattempt your failed payment daily for up to 3 consecutive days. You will be notified of the dishonour via email.

Should your payment fail to settle within 3 days, you give permission to GYM to charge a payment declined fee of $10.

If additional attempts to process your payment fails, GYM may suspend your use of the facility and cancel booked classes until all debts are paid in full. If payment is not received within seven (7) days, your Membership may be cancelled.


MEMBERSHIP CANCELLATION
You may cancel your Membership agreement at any time by completing the online cancellation form. Your request to cancel your Membership will be responded to within a maximum of seven (7) days.

You acknowledge that your Membership will be cancelled on the last day of your next GYM Membership payment cycle.

You acknowledge that if you choose to cancel your Membership and re-join, your Membership will be reinstated at the current retail pricing.

If you become unable to use GYM facility due to permanent physical/medical illness or incapacity, you may cancel your Membership prior to the last day of your next GYM Membership payment cycle. Cancellation of Membership will take immediate effect from the date we receive a written medical certificate from a qualified medical practitioner.


MEMBERSHIP HOLD
You acknowledge that you may place your Membership on hold at any time, with reasonable evidence provided to GYM via the online hold form. A Membership hold requires seven (7) days’ notice to GYM to come into effect.

A Membership hold can be applied to your Membership for a minimum of fourteen (14) days, in line with your GYM Membership debit date, and applied in blocks of seven (7) days thereafter if required.

A membership hold will incur a $25 administration fee that will be applied to your account and processed on day 1 of your hold.

A membership hold can be applied to your Membership for a maximum of two (2) months during a twelve (12) month term. Should your required hold be longer than this timeframe, your membership will be cancelled (see Cancellation policy).

Upon expiration of your Membership hold period, your direct debit schedule will automatically resume. Should you request to cancel your membership at the end of your hold, you acknowledge that your membership will be cancelled according to the Cancellation Policy.

If your request to hold your Membership is due to temporary physical/medical illness or incapacity, GYM reserves the right to request a medical certificate from a qualified medical practitioner. Additionally, if you require longer than the maximum hold timeframe under such circumstances, please contact us via email (contact@athleticrev.com.au).


INTRO OFFER 1: 2 WEEK INTRO TEASER
GYM Intro Offer 1(valid for 2 weeks) is available for redemption to new clients only. Intro Offer 1 is non-refundable, non-transferable and cannot be paused.

Intro Offer 1 will activate from the date of your first class booking.

If you book your first class and fail to attend, your Introductory Offer will not be extended.

If you book a class at any time during your Introductory Offer and fail to attend, you acknowledge that you have forfeited the class and it will not be returned.

INTRO OFFER 2: 6 WEEK INTRO PROGRAM
GYM Intro Offer 2 (valid for 6 weeks) is available for redemption to new + existing clients. Intro Offer 2 is non-refundable, non-transferable and cannot be paused.

You agree to pay GYM $99.90, in advance on a 3x14-day autopay schedule by credit card transaction.

Intro Offer 2 will expire at the completion of the 3x14-day autopay schedule.

Intro Offer 2 will activate from the date of your purchase.

If you book a class at any time during your Intro Offer 2 and fail to attend, you acknowledge that you have forfeited the class and it will not be returned. You also acknowledge that your Intro Offer 2 will not be extended.

Intro Offer 2 is subject to our Late Cancel/No Show policy.

Intro Offer 2 includes 2 1:1 Coaching sessions that may be booked at any time during the program. GYM will coordinate the 2 sessions with an available Coach. If you fail to attend the sessions during the program, you accept that they will be forfeited.


CLASS PASSES
GYM Class Passes available for redemption are non-refundable, non-transferable and cannot be suspended.

Sessions can be extended due to temporary physical/medical illness or incapacity, in which case GYM reserves the right to request a written medical certificate from a qualified medical practitioner.

20 Class Pass is valid for six (6) months from date of purchase. 10 Class Pass is valid for three (3) months from date of purchase. 1 Class Pass is valid for one (1) month from date of purchase.


CLASS BOOKINGS
GYM requires that you book your Class via the Athletic Revolution App, Mindbody App or Website to reserve your spot.

To book a class you must have a pre-purchased session on your Athletic Revolution account. If you arrive at GYM without a pre-purchased session, you will be required to purchase a single Class Pass ($27) on arrival or it will be debited from your Athletic Revolution account.

If you arrive without a booking and Class is at full capacity, GYM cannot guarantee your spot.

A minimum of two (2) people is required for a class to proceed. Should a class need to be cancelled, you will be contacted via text 2 hours prior to the start of class and your session will be returned to your Athletic Revolution account.


LATE CANCEL + NO SHOW
If you are no longer able to attend a booked Class, it is your responsibility to cancel your reservation:
no less than 9 hours prior to AM class times
no less than 4 hours prior to PM class times

If you fail to cancel your class booking prior to the AM/PM cancellation window, you will be charged a $5 Late Cancel fee. If you are booked to attend Class and do not attend, you will be charged a $10 No Show fee.

All members on a recurring contract will have one (1) fee waived per calendar month.

Late Cancel + No Show charges will be debited via your Athletic Revolution account on the last day of every month.

A Late Cancel + No Show for Class Pass purchases incurs a session lost.


WAITLIST
If a class is at full capacity, you may add yourself to the Waitlist if you are sure you can commit to an opening. If a cancellation occurs outside of the cancellation window and you are #1 Waitlist, you will be automatically added to the class and notified via email.

If you are added to Class from the Waitlist and no longer wish to attend, it is your responsibility to cancel your booking to avoid late cancel/no show charges.


COMPLAINT PROCESS
You may submit a complaint concerning GYM and/or its service, members, owners or staff by delivering written notice via email (contact@athleticrev.com.au). After receiving a complaint, GYM will record the complaint on file, notify the complainant/acknowledge the complaint and endeavour to resolve as soon as practicably possible.


USE OF GYM
You acknowledge that it is your responsibility to correctly use the GYM equipment and facilities. If you are unsure how to correctly use or operate any of GYM equipment, please consult a GYM staff member for assistance.

Any equipment used is the property of GYM and must be treated with respect and care. If your behaviour or use of GYM equipment and its facility is not deemed acceptable, your Membership may be terminated by GYM, at its sole discretion. It is GYM right to change, add or remove equipment at its discretion without notice.

It is your responsibility to wear suitable clothing and closed footwear at all times when using GYM equipment and facilities.

Membership is limited to persons who are at least 15 years of age. GYM recommend that members less than 18 years of age are supervised by a parent or legal guardian when using GYM equipment and facilities.

You acknowledge that any belongings left behind will be kept in lost property at GYM for a maximum of four (4) weeks, after which time will be donated to charity.


PERSONAL TRAINING SERVICES
GYM may offer procure services such as personal training from third party service providers (Third Party Service). Any claim you may have as a result of an act or failure to act by a Third Party Service Provider will be brought against, and will be the responsibility of that Third Party Service Provider.

You hereby release, indemnify and keep indemnified GYM for any claim by you as a result of an act or omission by a Third Party Service Provider. You must notify GYM immediately if you have a claim against a Third Party Service Provider. GYM will at all times assist, where possible, to resolve any conflict or issues with a Third Party Service Provider.


PHYSICAL OR MEDICAL CONDITIONS
It is your responsibility to notify GYM of any medical or physical conditions prior to commencing GYM equipment and its facilities, or in the event that your medical or physical condition changes at any time during your membership. Any advice and/or recommendation provided by a GYM Coach is not intended to constitute medical diagnosis or treatment. It is your responsibility to obtain medical advice from your doctor or treating practitioner prior to commencing the use of GYM equipment and facilities.


ASSUMPTION OF RISK
You are aware that the use of the premises and its facilities and your participation in classes and programs conducted by GYM may involve strenuous activity and special risks. You warrant that you are physically able to use any GYM equipment and facilities, and have not been advised otherwise by your doctor or treating practitioner. You further warrant that you have no pre-existing medical condition that would otherwise prevent you from using the GYM facilities and/or participating in any classes/fitness program.

You understand that you will be engaging in activities that may involve risk of personal injury or illness and which may also involve the risk of economic/property loss and damage. You also understand that there may be risks involved that are not known to you or to GYM, or may not be foreseen or reasonably foreseeable at this time or at the time of using the GYM facilities or participating in the class/fitness program.

You assume the foregoing risks including the risk of: (a) any and all damages, accidents and personal injury that you may suffer while using the GYM, its equipment and its facilities; and (b) any negligence by the GYM and its respective owner or coaches accept personal responsibility for any injury (including but not limited to personal injury and disability), illness, damage, loss, claim, liability or expense of any kind or nature, that you may suffer arising out of or in connection with the use of the GYM, its equipment or its facilities or participation in classes/fitness programs.


LIMITATION OF LIABILITY
In consideration of the GYM granting you Membership, you: (a) release and forever discharge the GYM from all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses howsoever arising that you may have incurred arising from or in connection with your Membership and/or use of GYM equipment and facilities, or from being on GYM premises to the fullest extent permitted by law and whether caused or contributed to (directly or indirectly) by any act of negligence, breach of duty or default/omission on the part of GYM and its respective owners, directors, officers, employees or agents. (b) agree that the GYM will not be liable for any loss, damage or theft of any of your (or your guest’s) property except where caused by the gross negligence of GYM.

Further, you agree that the GYM will not be liable for any death, personal injury or illness occurring on GYM premises or as a result of use of facilities or equipment, except to the extent that it arises from the gross negligence of GYM and its respective owners, directors, officers, employees or agents.


MISCELLANEOUS
Use of GYM may from time to time take your moving and still imagery during Personal Training sessions or Classes. You consent to GYM taking your image and you authorise it to use, reproduce and communicate your photo in all media formats for the purpose of marketing and promoting of GYM services.

You consent to GYM sending you marketing correspondence via email, text or Facebook Group which may include (but not limited to) GYM updates and promotional material. You may opt-out at any time.
